What happened? The Claimant (Mr X) was a driver who was involved in an accident. His vehicle was hit in the rear while stationary at traffic lights and injuries suffered to his neck and shoulder along with travel anxiety. Liability was admitted.
Mr X’s solicitors made offers of settlement, but these were disputed and lower counter offers were made. His solicitors then issued proceedings in an attempt to settle the dispute over the value of the Claimant’s General Damages.
Temple provided the Claimant with legal expenses insurance to cover the claim for adverse costs should they not be successful in beating any offers made by the defendant’s solicitors.
This gave the Claimant the opportunity to pursue their claim in the full knowledge that he has protection for any adverse costs as well as assisting him with disbursements such as the court fee if required in bringing his case.
Temple also offered to assist with any proposed mediation if it was required as an alternative way of achieving a settlement.
