ATE Insurance and disbursement funding for Northern Ireland

Competitive premiums, cover for counsel’s fees and more – for commercial disputes and clinical negligence cases

What is ATE Insurance and Disbursement Funding?

ATE insurance is cover taken out in connection with a legal action. It protects the claimant against adverse costs, their own disbursements and counsel’s fees if the case is unsuccessful, in return for a premium that is payable only if the case succeeds.

Our ATE Insurance also comes with the option of a disbursement funding loan, which enables your clients to borrow the money for disbursements (excluding counsel’s fees) throughout the lifetime of the case, reducing the financial burden on them.

Extensive research, dialogue and data collection was carried out so that our ATE insurance product is fit for purpose and bespoke to Northern Ireland’s litigation environment. It includes –

  • Competitive and proportionate premiums
  • Cover for counsel’s fees
  • Disbursement funding
  • Delegated authority

Temple Legal Protection is one of the leading providers of ATE insurance, with over 25 years’ experience and best-in-class service. We are fully authorised and regulated by the Financial Conduct Authority, with our ‘A’ Rated insurance provided in partnership with Intact Insurance UK Limited.

Delegated Authority and How It Works?

We offer a delegated authority scheme for solicitors handling personal injury and clinical negligence cases in Northern Ireland.

This enables solicitors to issue policies directly, without requiring prior approval from Temple. Delegated authority gives firms greater control and efficiency, allowing cases to progress without administrative delay.

The delegated authority scheme can be administered through the Temple Online Policy System (TOPS). Developed in-house, TOPS provides instant decisions – simply enter your case details online and your client can be covered immediately under a comprehensive, A-rated ATE insurance policy.

Common FAQs

Some of the key questions about After the Event Insurance for Northern Ireland.

  • ATE insurance (also known as litigation insurance) from Temple provides the security that parties need when engaged in a legal dispute. In the event of an unsuccessful case, our insurance covers own disbursements, own counsel fees and adverse costs.
  • Clients who have an ATE insurance policy with us can automatically benefit from the use of our disbursement funding, which enables them to drawdown money on a CCA so they are not out of pocket for disbursements as the case progresses.
  • Temple take assume a large amount of the risk, ensuring that plaintiffs can pursue their legal actions with more certainty around the potential cost, paving the way for firms to attract more client interest and run cases that otherwise may have been discontinued early due to lack of funding for the plaintiffs.
  • We can insure a wide range of disputes, including personal injury, clinical negligence, and commercial litigation.
  • We’re confident our pricing is extremely competitive and fair. Our new premiums have been carefully calculated to be workable and attractive to your clients.

  • We will consider a case at any stage – whether at the outset when medical records have just been reviewed, after response from the Opponent, or after the Writ has been issued.
  • We provide a total LOI tailored to each case. This single LOI will cover all of the elements of the claim we insure – namely own disbursements, own counsel’s fees and adverse costs.
