Personal Injury ATE Insurance

The insurance cover, expertise and service you and your clients need in a competitive market

The Evolving Personal Injury Landscape

The legal landscape for solicitors in the personal injury market has changed dramatically since the introduction of Legal Aid, Sentencing and Punishment of Offenders Act 2012 (LASPO), and it continues to evolve at a rapid pace. Law firms have had to adapt to a range of developments, including the introduction of fixed costs, changes in how work is sourced, rising expert fees, and increasing court fees.

Despite these challenges, the market remains highly competitive. The evolving legal environment has led to tighter margins, meaning law firms must work just as hard as ever while finding innovative ways to stay profitable. This includes embracing new technologies and meeting clients growing expectations. Today, there is a strong demand for streamlined processes, transparent communication, and faster case resolutions, all of which are driving innovation in personal injury case management.

I have relied exclusively on Temple for ATE insurance for the past 8 years.  They were willing to provide cover to a firm newly commencing asbestos disease work.  They recognised my previous experience with other firms and expertise in this area of practice.  The product itself is excellent, providing all the cover required at reasonable premium levels.  The delegated nature of the scheme allows for seamless arrangement of policies through the excellent online portal.  On the few occasions a claim has been necessary under a policy, Temple have been understanding, helpful and efficient in reimbursing the cost of disbursements and court fees.  I have felt throughout my involvement with Temple that it is an arrangement based on mutual trust.  They have demonstrated repeatedly that they rely on the skill and knowledge of those they insure, and I have been reassured that I can rely on them if claims are not successful.  Without the support of Temple I would not have been able to operate my asbestos litigation practice in the way I have.

Temple Insurance is an intrinsic part of our litigation model, and in our view, provides maximum protection for our clients at a very reasonable premium. We have been insuring with temple insurance for about 15 years, and before that we tried several other insurance companies.  Temple have been supportive all the way through. They are not overly risk averse, and when a claim fails, they assess our claim fairly and rapidly. I cannot remember a single time when our claim for reimbursement of disbursements has been refused unfairly. Before we used Temple, time and again we faced unreasonable challenges to our insurance claim. I  would recommend any litigation department to rely exclusively on the temple insurance product.

Common FAQs

Some of the key questions about Personal Injury After the Event Insurance. Can’t find the question? go to our FAQs page.

This insurance covers the claimant’s own reasonable disbursements, such as court issue fees and expert fees, which are incurred while pursuing a legal claim. In addition to these disbursements, ATE insurance provides crucial protection against the risk of having to pay the opponent’s legal costs. The insurance safeguards claimants from liability for the opposing party’s costs if the claim is unsuccessful by providing cover to pay opponents costs from the date of the ‘Part 36’ offer up to and including the trial. By offering this dual coverage, our ATE insurance enables individuals to pursue justice without the fear of substantial financial loss, making legal action more accessible and less risky for those seeking compensation for personal injuries.
In personal injury cases, when a claim is successful, the premium for the ATE insurance policy is payable by the claimant. This payment is made from the damages that are recovered as a result of the claim. Essentially, the cost of the insurance does not need to be paid upfront or during the course of the proceedings; instead, it is settled from the compensation awarded to the claimant at the conclusion of a successful case. This arrangement helps ensure that claimants can pursue legal action without worrying about immediate insurance costs, making access to justice more attainable.
Our After The Event (ATE) insurance offers a wide range of benefits to claimants seeking to pursue personal injury claims. The policy provides coverage of up to £250,000, which can be obtained efficiently via the TOPS online portal, helping to avoid unnecessary time and costs. One of the key advantages is the fully deferred premium, which is only payable if the claim is successful; if the claim is unsuccessful, the premium is not payable at all. The insurance also offers retrospective cover from the date of the retainer, ensuring comprehensive protection from the outset. With competitively priced premiums, claimants can pursue their cases to the fullest extent without financial barriers. Importantly, the policy removes the risk of having to pay the opponent’s legal costs if the dispute is not successful and can also provide protection from interim costs orders, giving claimants greater peace of mind throughout the legal process.
