How to obtain insurance
With personal injury cases, we prefer solicitors’ firms to offer insurance to their clients through a delegated authority scheme. This allows a firm to issue certificates of insurance to their clients directly, where the case falls within the parameters of a scheme.
We typically look for a minimum of 60 cases to be insured through a scheme per annum.
The schemes provide full delegated authority, giving the firm freedom to run the case to trial without having to obtain our consent every step of the way, for example, to make or reject offers of settlement or to issue court proceedings.
If you would like to talk to an underwriter about a delegated authority scheme, please contact us. Alternatively, please complete the Scheme Application Form and return it to us with supporting documents as requested on the form. One of the underwriters will then contact you to discuss a scheme.

Temple’s track record
We have been offering delegated authority schemes since 1999. We introduced deferred premiums in that year, then two years on, we began using stepped premiums.
Our experience in this market is unrivalled, having been involved in almost all of the cases that have established the law in the area of ATE insurance.
We insured the successful claimants in:
Callery v Gray [2001] EWCA Civ 1246 and [2002] UKHL 28, which established that insurance could be obtained early on in the case.
Sarwar v Alam [2001] EWCA Civ 1401, which considered the use of ATE insurance where the client had the benefit of a BTE policy.
Tilby v Perfect Pizza, February [2002] MC 003838, Hurst J, which established that Temple’s insureds did not need to enter into a consumer credit act agreement in respect of the premium
We also intervened in the recent case of Rogers v Merthyr Tydfil BC [2006] EWCA Civ 1134, which confirmed the legitimacy of the stepped premium model.
